(A consumer is any natural person who enters into a legal transaction which predominantly cannot be attributed to their commercial or independent professional activity.)
Right of Withdrawal
You have the right to withdraw from this contract within 30 days without giving any reason.
The withdrawal period is 30 days from the date:
- on which you, or a third party designated by you (who is not the carrier), have taken possession of the goods, provided that you ordered one or more goods in one order and they were delivered together;
- on which you, or a third party designated by you (who is not the carrier), have taken possession of the last goods, provided that you ordered several goods in one order and they were delivered separately.
- To exercise your right of withdrawal, you must inform us of your decision to withdraw from this contract. This can be done by email: you@guiltygallery.com.
You may use the attached model withdrawal form, but this is not mandatory.
To comply with the withdrawal period, it is sufficient that you send your notification concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Consequences of Withdrawal
If you withdraw from this contract, we will reimburse all payments we have received from you, including delivery costs (with the exception of additional costs resulting from your choice of a type of delivery other than the least expensive standard delivery offered by us), without undue delay and no later than 30 days after we receive your notice of withdrawal.
For this reimbursement, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise. In no case will this reimbursement incur any additional costs for you.
We may withhold reimbursement until we have:
- received the returned goods, or
- you have provided proof that you have returned the goods,
whichever occurs first.
You must return the goods to us without undue delay and in any event no later than 30 days from the day on which you inform us of the withdrawal of this contract. The deadline is met if you send the goods back before the period of 30 days has expired.
The direct costs of returning the goods shall be borne by you.
You are only liable for any diminished value of the goods if this loss in value is due to handling of the goods beyond what is necessary to establish the nature, characteristics, and functioning of the goods.
Reasons for Exclusion and Expiry of the Right of Withdrawal
The right of withdrawal does not apply to contracts:
- for the supply of goods that are not prefabricated and are produced based on an individual choice or decision by the consumer;
- for the supply of goods that spoil quickly or have a limited shelf life;
- for the supply of alcoholic beverages, the price of which was agreed in the contract but which can only be delivered at the earliest 30 days after the conclusion of the contract and whose value depends on market fluctuations;
- for the supply of newspapers, journals, or magazines, with the exception of subscription contracts.
The right of withdrawal expires prematurely for contracts:
- for the supply of sealed goods which are not suitable for return for health protection or hygiene reasons, if the seal has been broken after delivery;
- for the supply of goods that, after delivery, are inseparably mixed with other goods due to their nature;
- for the supply of audio or video recordings and computer software in sealed packaging, if the seal has been removed after delivery.
